Every employee in Switzerland is entitled to a work reference at any time. It must be complete, truthful, and positive in tone. Swiss work references use a coded language with specific formulations – knowing the code can make a significant difference in your job search.
Legal Entitlement
Art. 330a OR gives every employee an unconditional, time-unlimited right to a work reference. Two types exist: the qualified reference (assessing performance and conduct – the standard) and the simple reference (only position and duration, without evaluation – on express employee request). The qualified reference is the norm in Switzerland.
What a Work Reference Must Contain
A complete work reference includes: personal details (name, date of birth), employment duration, job description, performance assessment (quality, quantity, reliability), conduct assessment (toward managers, colleagues, clients), reason for departure (optional), and closing formula. The closing must be positive and include good wishes for the future.
The Coded Language
Swiss work references use encoded formulations that signal performance levels. Examples: 'always to our fullest satisfaction' (sehr gut / excellent), 'to our full satisfaction' (gut / good), 'to our satisfaction' (befriedigend / adequate), 'broadly to our satisfaction' (ungenügend / below expectations). Qualifications and omissions are deliberate signals – read references carefully.
Requesting Corrections
You can request a correction at any time, including after termination, with no statute of limitations. If the employer refuses, you may take the matter to the labour court (Arbeitsgericht / tribunal des prud'hommes). The court assesses whether the reference is truthful and positive in tone – not whether it corresponds to the employee's wishes.
